L\u2019id\u00e9e est surprenante du point de vue de la th\u00e9orie de l\u2019Etat mais une \u00e9vidence du point de vue de la sociologie de l\u2019action publique, du management strat\u00e9gique, du droit transnational et des best practices de l\u2019industrie extractive mondiale.<\/p>\n<h2>La r\u00e9sistance \u00e0 l&rsquo;action publique<\/h2>\n<p style=\"text-align: justify;\">Une politique l\u00e9gislative, un plan relatif aux \u00e9nergies renouvelables, une taxe fiscale -quand bien m\u00eame elle est \u00e9cologique- un projet d\u2019a\u00e9roport pourtant port\u00e9e par une collectivit\u00e9 publique, un projet de mine d\u2019or en Guyane fran\u00e7aise, un projet de parc \u00e9olien dans la baie de Saint-Brieuc, etc. autant d\u2019exemples bien connus de politiques publiques nationales ou locales tenus en \u00e9chec par les populations nationales ou locales : Une politique publique doit d\u00e9sormais, pour \u00eatre effective, \u00eatre accept\u00e9e par la population.<\/p>\n<h2>Rechercher la participation<\/h2>\n<p style=\"text-align: justify;\">La notion de licence sociale et environnementale \u00e9labor\u00e9e pour les projets extractifs transnationaux permet de comprendre les enjeux et les m\u00e9thodes d\u2019un nouvelle politique publique visant a obtenir l\u2019acceptation sociale des populations. Un op\u00e9rateur \u2013 par exemple minier- doit certes obtenir en droit l\u2019autorisation d\u2019op\u00e9rer de l\u2019Etat (la licence l\u00e9gale) mais aussi en pratique d consulter les populations locales pour obtenir leur participation au projet (Licence dite Sociale et Environnementale d\u2019Op\u00e9rer ou Sustainable Development License to Operate -SDLO). D\u00e9sormais cette simple pratique de participation est plus importante que le droit : Soit la licence l\u00e9gale est subordonn\u00e9e a cette pratique de participation ; soit la licence l\u00e9gale est accord\u00e9e mais l\u2019absence de licence sociale met tout de m\u00eame fin au projet.<\/p>\n<h2>Produire l&rsquo;acceptation sociale<\/h2>\n<p style=\"text-align: justify;\">Bien que l\u2019importance de la licence sociale fasse consensus tant chez les professionnels que les chercheurs, peu de travaux sont consacr\u00e9s aux modalit\u00e9s pratiques et effective de la participation des populations locales, le droit fran\u00e7ais paraissant pour tous obsol\u00e8te (\u00e9valuation environnementale, participation locale, etc.) Et pourtant, des m\u00e9thodes peuvent \u00eatre pr\u00e9conis\u00e9es pour que l\u2019action publique recueille une telle acceptation des populations. Cette m\u00e9thode permet de d\u00e9terminer pr\u00e9cis\u00e9ment les acteurs, mais aussi les pr\u00e9occupations de chaque acteur dans une dynamique inclusive pour que chaque question soulev\u00e9e puisse trouver une solution concr\u00e8te lors de l\u2019\u00e9laboration du projet\/action publique.
