Cependant, pour \u00eatre efficaces, ces politiques doivent \u00eatre coh\u00e9rentes, ambitieuses et bien con\u00e7ues. Comme le montre la litt\u00e9rature sur le policy design (Ashford et al., 1985), plusieurs \u00e9l\u00e9ments sont d\u00e9terminants : la clart\u00e9 des objectifs, la flexibilit\u00e9 des instruments, mais surtout la s\u00e9v\u00e9rit\u00e9 de la r\u00e9glementation. Dans le contexte de l\u2019innovation verte, la s\u00e9v\u00e9rit\u00e9 r\u00e9glementaire d\u00e9signe le niveau d\u2019exigence impos\u00e9 aux entreprises pour r\u00e9duire leur impact environnemental. Cette s\u00e9v\u00e9rit\u00e9 peut se manifester par des objectifs de r\u00e9duction tr\u00e8s ambitieux, des co\u00fbts \u00e9lev\u00e9s de conformit\u00e9 avec les technologies existantes, ou encore la n\u00e9cessit\u00e9 de changements technologiques profonds (Ashford et al., 1985). Pour autant, ce n\u2019est pas seulement la s\u00e9v\u00e9rit\u00e9 \u00ab r\u00e9elle \u00bb qui compte : ce qui importe aussi, c\u2019est la mani\u00e8re dont elle est per\u00e7ue par les acteurs \u00e9conomiques, notamment les entreprises et leurs clients. Les recherches empiriques et th\u00e9oriques ont montr\u00e9 que la perception de la s\u00e9v\u00e9rit\u00e9 joue un r\u00f4le tout aussi fondamental que la s\u00e9v\u00e9rit\u00e9 objective. Lorsque les entreprises croient r\u00e9ellement \u00e0 la menace d\u2019une future interdiction ou d\u2019un durcissement de la r\u00e9glementation, elles sont plus enclines \u00e0 anticiper et \u00e0 innover (Segerson and Micelli, 1998). En particulier, la cr\u00e9dibilit\u00e9 de la menace r\u00e9glementaire est essentielle pour fixer des objectifs ambitieux dans les accords volontaires ou les dispositifs incitatifs. Mais cette cr\u00e9dibilit\u00e9 repose souvent sur l\u2019\u00e9quilibre entre rigueur et r\u00e9alisme. Une r\u00e9glementation trop souple est facilement contourn\u00e9e, tandis qu\u2019une r\u00e9glementation trop s\u00e9v\u00e8re peut \u00eatre vue comme irr\u00e9aliste, ce qui affaiblit son pouvoir incitatif (Ashford et al., 1985). \u00a0Le r\u00e8glement europ\u00e9en REACH, qui encadre les substances chimiques, est un bon exemple pour analyser ces dynamiques. Bien qu\u2019il ait \u00e9t\u00e9 con\u00e7u pour encourager le remplacement des substances les plus dangereuses, sa mise en \u0153uvre repose sur une logique flexible et \u00e9volutive, notamment via la proc\u00e9dure d\u2019autorisation et l\u2019obligation de recherche d\u2019alternatives techniquement et \u00e9conomiquement viables. Cette flexibilit\u00e9, si elle permet une adaptation progressive, peut \u00e9galement affaiblir la perception de la s\u00e9v\u00e9rit\u00e9. Les entreprises pourraient ainsi retarder leurs efforts d\u2019innovation en se contentant d\u2019am\u00e9liorations incr\u00e9mentales (CSES, 2012), surtout si elles doutent de l\u2019imminence ou de la cr\u00e9dibilit\u00e9 d\u2019une interdiction.<\/p>\n<p style=\"text-align: justify;\"><em>\u00a0<\/em><\/p>\n<p style=\"text-align: justify;\"><strong><em>La perception r\u00e9glementaire guide la transition technologique<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Nos travaux (Arfaoui et al. 2014\u00a0; Brouillat et al., 2018\u00a0; Brouillat and Saint Jean, 2020) mettent lumi\u00e8re un r\u00e9sultat cl\u00e9 : la s\u00e9v\u00e9rit\u00e9 per\u00e7ue a un r\u00f4le d\u00e9cisif surtout lorsque la s\u00e9v\u00e9rit\u00e9 objective est faible. Dans les cas o\u00f9 la r\u00e9glementation est objectivement s\u00e9v\u00e8re, cette s\u00e9v\u00e9rit\u00e9 suffit \u00e0 elle seule pour stimuler la transition technologique. La perception joue un r\u00f4le secondaire. En revanche, dans des contextes r\u00e9glementaires plus souples, la s\u00e9v\u00e9rit\u00e9 per\u00e7ue par les clients devient le moteur principal de l\u2019innovation. Lorsqu\u2019ils croient fortement \u00e0 une future interdiction d\u2019une technologie polluante, ils se tournent vers des alternatives. Cela pousse les fournisseurs \u00e0 innover, m\u00eame sans obligation directe (effet de \u00ab demand pull \u00bb). \u00c0 l\u2019inverse, si seuls les fournisseurs per\u00e7oivent une forte menace r\u00e9glementaire mais que les clients restent attach\u00e9s \u00e0 la technologie polluante, la transition s\u2019enlise. Les fournisseurs n\u00e9gligent les am\u00e9liorations de la technologie polluante (technologie encore autoris\u00e9e), et la diffusion des alternatives propres ne compense pas ce manque, entra\u00eenant in fine des performances environnementales inf\u00e9rieures au sc\u00e9nario sans r\u00e9glementation.<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\"><strong><em>Perception h\u00e9t\u00e9rog\u00e8ne selon les acteurs<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Par ailleurs, nos travaux soulignent que la perception de la r\u00e9glementation peut varier selon la position dans la cha\u00eene de valeur. Les clients finaux, souvent plus expos\u00e9s aux pressions sociales ou r\u00e9glementaires, peuvent anticiper des changements que les fournisseurs, moins inform\u00e9s ou moins expos\u00e9s, sous-estiment. Cette asym\u00e9trie peut cr\u00e9er des tensions ou des d\u00e9salignements dans les efforts d\u2019innovation.<\/p>\n<p style=\"text-align: justify;\"><em>\u00a0<\/em><\/p>\n<p style=\"text-align: justify;\"><strong><em>Renforcer la croyance des clients et la cr\u00e9dibilit\u00e9 des alternatives<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Dans ce contexte, deux grandes implications politiques se d\u00e9gagent : Premi\u00e8rement, renforcer la perception de la s\u00e9v\u00e9rit\u00e9 chez les clients peut avoir un effet d\u00e9clencheur sur l\u2019ensemble de la cha\u00eene de valeur. Par exemple, l\u2019\u00e9tiquetage environnemental pourrait rendre plus visible la dangerosit\u00e9 de certaines substances et accro\u00eetre la perception de leur probable interdiction future. Il contribuerait \u00e9galement \u00e0 une classification plus rapide des substances pr\u00e9occupantes (notamment les perturbateurs endocriniens).
