{"id":3103,"date":"2021-04-22T14:16:00","date_gmt":"2021-04-22T12:16:00","guid":{"rendered":"http:\/\/observatoire-asap.org\/?p=3103"},"modified":"2021-04-22T22:11:18","modified_gmt":"2021-04-22T20:11:18","slug":"big-data-et-droit-une-question-de-pouvoir-et-de-position-dominante","status":"publish","type":"post","link":"https:\/\/observatoire-asap.org\/index.php\/2021\/04\/22\/big-data-et-droit-une-question-de-pouvoir-et-de-position-dominante\/","title":{"rendered":"Big Data et droit, une question de pouvoir et de position dominante"},"content":{"rendered":"<p style=\"text-align: justify;\">Alors que la loi Informatique et libert\u00e9s de 1978 est n\u00e9e suite \u00e0 une controverse sur un <a href=\"http:\/\/observatoire-asap.org\/index.php\/2021\/03\/31\/le-difficile-arbitrage-public-entre-ethique-et-transformation-numerique\/\">projet<\/a> men\u00e9 par l\u2019Etat, le <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A32016R0679\">R\u00e8glement g\u00e9n\u00e9ral sur la protection des donn\u00e9es<\/a> (RGPD) est n\u00e9 suite \u00e0 la constatation du pouvoir grandissant des GAFAM ou des \u00ab\u00a0Big Tech[1]\u00a0\u00bb, face au \u00ab\u00a0Big Data\u00a0\u00bb, les m\u00e9gas bases de donn\u00e9es que ces entreprises constituent sur leurs utilisateurs.<\/p>\n<h2 style=\"text-align: justify;\">D\u00e9finition du Big Data<\/h2>\n<p style=\"text-align: justify;\">Le <a href=\"https:\/\/www.youtube.com\/watch?v=bAyrObl7TYE\">Big Data<\/a> d\u00e9signe le fait de d\u00e9tenir d\u2019importants volumes de donn\u00e9es, peu important que les donn\u00e9es soient structur\u00e9es ou non. Le Big Data se caract\u00e9rise par la r\u00e8gle des 3V :<\/p>\n<ul style=\"text-align: justify;\">\n<li>le Volume\u00a0: le Big Data implique la collecte de gigantesques volumes de donn\u00e9es brutes,<\/li>\n<li>la Vari\u00e9t\u00e9\u00a0: le Big Data est compos\u00e9 de donn\u00e9es h\u00e9t\u00e9rog\u00e8nes, structur\u00e9es ou non,<\/li>\n<li>la Vitesse\u00a0: les donn\u00e9es sont g\u00e9n\u00e9r\u00e9es \u00e0 \u00ab grande vitesse \u00bb voire en continue, ce qui implique de les traiter rapidement, voire en temps r\u00e9el.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Sont ajout\u00e9es parfois 2 ou 3 autres V, ayant trait \u00e0 la gestion des donn\u00e9es issues du Big Data plut\u00f4t qu\u2019\u00e0 sa d\u00e9finition propre\u00a0:<\/p>\n<ul style=\"text-align: justify;\">\n<li>la V\u00e9racit\u00e9\u00a0: par d\u00e9faut, les donn\u00e9es comportent du \u00ab bruit \u00bb, des informations incompl\u00e8tes voire erron\u00e9es.<\/li>\n<li>Cela renvoie \u00e0 la Volatilit\u00e9, c\u2019est-\u00e0-dire la \u00ab dur\u00e9e de vie \u00bb des donn\u00e9es g\u00e9n\u00e9r\u00e9es, autrement dit, pendant combien de temps elles sont valides.<\/li>\n<li>la Validit\u00e9 ou Valeur\u00a0: les donn\u00e9es doivent \u00eatre \u00ab\u00a0propres\u00a0\u00bb pour \u00eatre exploitables. Elles doivent \u00eatre exactes et avoir \u00e9t\u00e9 collect\u00e9es de mani\u00e8re licite. Cela renvoie aux notions de v\u00e9racit\u00e9 et volatilit\u00e9 de la donn\u00e9e.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Sans cadre l\u00e9gal, le Big Data est mis en place de mani\u00e8re \u00ab\u00a0sauvage\u00a0\u00bb via par exemple des outils de web scraping[2], qui est une pratique r\u00e9pandue de growth hacking[3]. On collecte des donn\u00e9es parce qu\u2019on peut techniquement le faire, sans d\u00e9finir pr\u00e9alablement ce \u00e0 quoi elles pourront servir.<\/p>\n<h2 style=\"text-align: justify;\">La donn\u00e9e, \u00e9l\u00e9ment sociopolitique conf\u00e9rant le pouvoir aux entreprises qui la d\u00e9tienne<\/h2>\n<p style=\"text-align: justify;\">Les Big Tech ont acquis un pouvoir sans pr\u00e9c\u00e9dent gr\u00e2ce au Big Data. Les Big Tech peuvent anticiper la demande, voire \u00ab cr\u00e9er \u00bb les besoins des individus. La donn\u00e9e collect\u00e9e massivement est devenue un \u00e9l\u00e9ment sociopolitique qui conf\u00e8re le pouvoir \u00e0 ceux qui la d\u00e9tienne. Le scandale le plus connu est celui touchant Facebook : les donn\u00e9es personnelles de millions d&rsquo;utilisateurs de Facebook ont \u00e9t\u00e9 collect\u00e9es sans leur consentement par <a href=\"https:\/\/www.theguardian.com\/technology\/2019\/mar\/17\/the-cambridge-analytica-scandal-changed-the-world-but-it-didnt-change-facebook\">la soci\u00e9t\u00e9 britannique Cambridge Analytica<\/a>, pour \u00eatre utilis\u00e9es principalement \u00e0 des fins de publicit\u00e9 politique.<\/p>\n<p style=\"text-align: justify;\">C\u2019est ce que le RGPD s\u2019emploie \u00e0 r\u00e9guler en imposant aux entreprises des obligations pour assurer la lic\u00e9it\u00e9 d\u2019un traitement.<\/p>\n<p style=\"text-align: justify;\">Toutefois, ces obligations ne suffisent pas \u00e0 limiter le pouvoir des Big Tech. Les donn\u00e9es peuvent toujours \u00eatre collect\u00e9es de mani\u00e8re licite, avec le consentement des utilisateurs, enclins \u00e0 se d\u00e9partir d\u2019une partie de leur vie priv\u00e9e au profit d\u2019un outil gratuit, pr\u00e9sentant des avantages ind\u00e9niables en termes d\u2019efficacit\u00e9 et d\u2019ergonomie, en un mot \u00ab\u00a0user-friendly\u00a0\u00bb. En cons\u00e9quence, le pouvoir de ces entreprises reste plus fort que jamais, pouvoir encore accru avec la pand\u00e9mie et les restrictions de d\u00e9placement impos\u00e9es.<\/p>\n<h2 style=\"text-align: justify;\">Le Digital Services Act et le Digital Markets Act<\/h2>\n<p style=\"text-align: justify;\">C\u2019est dans ce contexte que deux projets de r\u00e8glements europ\u00e9ens<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> sont en cours de discussion afin de r\u00e9guler les services et march\u00e9s num\u00e9riques et limiter le pouvoir d\u2019entreprises en position dominante, avec un arsenal d\u2019outils conf\u00e9rant aux autorit\u00e9s de la concurrence la capacit\u00e9 d\u2019agir plus rapidement et de frapper plus fort. Le <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/TXT\/?qid=1608117147218&amp;uri=COM%3A2020%3A825%3AFIN\">Digital Services Act<\/a> vise \u00e0 lutter contre la diss\u00e9mination des contenus illicites lorsque le <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/TXT\/?qid=1608116887159&amp;uri=COM%3A2020%3A842%3AFIN\">Digital Markets Act<\/a> vise \u00e0 garantir que les march\u00e9s num\u00e9riques restent innovants et ouverts \u00e0 la concurrence avec des relations commerciales loyales et \u00e9quilibr\u00e9es vis-\u00e0-vis des gros acteurs du march\u00e9.<\/p>\n<p style=\"text-align: justify;\">Il s\u2019agit de\u00a0<a href=\"https:\/\/www.courrierinternational.com\/article\/gafam-leurope-engage-la-bataille-contre-les-geants-du-numerique\">r\u00e9\u00e9quilibrer la dynamique de puissance du Big Data<\/a> et faire pencher la balance de l\u2019autre c\u00f4t\u00e9. Ces projets doivent faire l\u2019objet de d\u00e9bats au Parlement Europ\u00e9en puis au Conseil de l\u2019Union Europ\u00e9enne selon la <a href=\"https:\/\/www.consilium.europa.eu\/en\/council-eu\/decision-making\/ordinary-legislative-procedure\/\">proc\u00e9dure l\u00e9gislative ordinaire<\/a>.<\/p>\n<p><img loading=\"lazy\"
