Pourtant, depuis quelques ann\u00e9es, un ph\u00e9nom\u00e8ne est apparu plus visiblement dans les organisations de notre pays (Honor\u00e9, Galindo et Zannad, 2019). Ce <a href=\"https:\/\/news.gallup.com\/poll\/114211\/Alabamians-Iranians-Common.aspx\">nouvel objet de management<\/a> est <strong>l\u2019expression religieuse au travail. Elle est rencontr\u00e9e par plus de deux managers sur trois<\/strong> dans l\u2019espace professionnel hexagonal (Lionel Honor\u00e9, Institut Montaigne, 2019).<\/p>\n<p style=\"text-align: justify;\">L\u2019expression religieuse au travail recouvre <strong>l\u2019ensemble des comportements<\/strong> qui surviennent en contexte professionnel, issus de l\u2019interpr\u00e9tation que se fait une croyant de la doctrine religieuse \u00e0 laquelle il se r\u00e9f\u00e8re &#8211; <strong>ainsi que les r\u00e9actions associ\u00e9es<\/strong> \u00e0 ces comportements, qu\u2019elles soient directes ou indirectes, imm\u00e9diates ou diff\u00e9r\u00e9es (Gaillard, 2020). Elle est <strong>polyforme<\/strong> (p.ex. pri\u00e8res, signes, demandes d\u2019absences etc.), <strong>polys\u00e9mique<\/strong> (p.ex. marquer une s\u00e9paration, t\u00e9moigner d\u2019une tradition, partager une conviction), et <a href=\"https:\/\/theconversation.com\/fait-religieux-en-entreprise-un-phenomene-devenu-objet-de-management-105896\"><strong>situationnelle<\/strong><\/a>\u00a0(c-\u00e0-d. que les r\u00e9actions au sein des collectifs affectent la caract\u00e9risation du comportement par le groupe, ou par l\u2019individu lui-m\u00eame).<\/p>\n<p style=\"text-align: justify;\">Pour faire face \u00e0 ce ph\u00e9nom\u00e8ne, les entreprises s\u2019appuient principalement sur trois leviers\u00a0:<\/p>\n<p style=\"text-align: justify;\">1 &#8211; La <em>loi et la jurisprudence<\/em>. En <a href=\"https:\/\/theconversation.com\/quatre-situations-qui-illustrent-la-complexite-du-fait-religieux-au-travail-151712\">forte consolidation<\/a>, la conception fran\u00e7aise et europ\u00e9enne des <a href=\"https:\/\/theconversation.com\/dans-lunion-europeenne-les-entreprises-pourront-elles-choisir-dinterdire-le-voile-au-travail-156681\">accommodements raisonnables<\/a>\u00a0consid\u00e8re que <strong>c\u2019est \u00e0 l\u2019employ\u00e9 d\u2019adapter ses contraintes convictionnelles aux contraintes de l\u2019entreprise<\/strong>. Outre atlantique, c\u2019est exactement l\u2019inverse.<\/p>\n<p style=\"text-align: justify;\">2 \u2013 Depuis peu, elles peuvent plus facilement utiliser le<a href=\"https:\/\/theconversation.com\/religion-au-travail-perspectives-europeennes-et-outre-atlantique-75416\"><em> r\u00e8glement int\u00e9rieur<\/em><\/a> pour <strong>restreindre l\u2019expression religieuse au travail selon deux cat\u00e9gories de crit\u00e8res<\/strong>\u00a0: ceux qui rel\u00e8vent de la protection des individus (p.ex. hygi\u00e8ne, s\u00e9curit\u00e9), et ceux qui rel\u00e8vent de la bonne marche de l\u2019entreprise (p.ex. image, relation client, relations \u00e0 certains tiers). Elles sont toutefois encore tr\u00e8s peu nombreuses \u00e0 utiliser cet outil (Lionel Honor\u00e9, Institut Montaigne, 2019).<\/p>\n<p style=\"text-align: justify;\">3 &#8211; Les autres <em>outils de gestion<\/em> (p.ex. des guides, des formations, des fiches pratiques, des chartes, clubs d\u2019entreprise\u00a0; Galindo et Oiry, 2021), gr\u00e2ce auxquels elles affirment leur posture, et donnent des rep\u00e8res et un cadre aux <strong>managers de proximit\u00e9, souvent en premi\u00e8re ligne sur cette question<\/strong>.<\/p>\n<p style=\"text-align: justify;\">Nos travaux (Gaillard, 2020) montrent au moins <strong>quatre constats transversaux sur ce sujet des postures<\/strong>\u00a0:<\/p>\n<p style=\"text-align: justify;\">1 &#8211; La connaissance de la loi, du droit ne pr\u00e9suppose pas la connaissance de r\u00e8gle interne, c\u2019est-\u00e0-dire de la posture, puisque l\u2019entreprise dispose d\u2019une autonomie de positionnement sur les crit\u00e8res pr\u00e9cit\u00e9s.<\/p>\n<p style=\"text-align: justify;\">2 &#8211; La posture affich\u00e9e par l\u2019organisation, se distingue fr\u00e9quemment de la posture effectivement constat\u00e9e, v\u00e9cu par les salari\u00e9es, port\u00e9e par les managers.<\/p>\n<p style=\"text-align: justify;\">3 &#8211; Les facteurs manag\u00e9riaux plus mous, et la dimension relationnelle sont d\u00e9terminants pour faire accepter une d\u00e9cision, ce qui confirme l\u2019importance de la subsidiarit\u00e9, sans renoncer au soutien des services supports, parfois n\u00e9cessaires face aux cas plus probl\u00e9matiques (Lionel Honor\u00e9, Institut Montaigne, 2019)<\/p>\n<p style=\"text-align: justify;\">4 &#8211; L\u2019opposition entre universalit\u00e9 des postures et contextualisation de celles-ci penche vers les postures contextualis\u00e9es (Gaillard, 2020).<\/p>\n<p style=\"text-align: justify;\">Alors que deux r\u00e9alit\u00e9s bien distinctes s\u2019opposent d\u00e9j\u00e0 dans les entreprises, cette contextualisation des postures pourrait \u00e9galement avoir <strong>des cons\u00e9quences soci\u00e9tales, et conduire \u00e0 une triple polarisation en entonnoir<\/strong> :<\/p>\n<p style=\"text-align: justify;\">1- <em>Intersectorielle<\/em> : Entre les organisations publiques et priv\u00e9es, Neutralit\u00e9 des agents d\u2019un c\u00f4t\u00e9, libert\u00e9 de culte de l\u2019autre en principe\u00a0;<\/p>\n<p style=\"text-align: justify;\">2 &#8211; <em>Inter organisationnelle<\/em> : Entre les entreprises qui restreignent au-del\u00e0 des crit\u00e8res de fonctionnement, de sant\u00e9\/s\u00e9curit\u00e9, et utilisent notamment les crit\u00e8res d\u2019image ou encore d\u2019int\u00e9r\u00eat commercial, jug\u00e9s plus excluantes par les salari\u00e9s croyants et pratiquants\u00a0;<\/p>\n<p style=\"text-align: justify;\">3 \u2013 <em>Intra organisationnelle<\/em> : Entre les postes restreints par exemple par la relation client\u00e8le et ceux qui ne le sont pas, par exemple au si\u00e8ge ou en <em>back office<\/em>.<\/p>\n<p style=\"text-align: justify;\">Cette polarisation invite les entreprises \u00e0 la recherche d\u2019un point d\u2019\u00e9quilibre, afin que <strong>l\u2019expression religieuse ne constitue ni un passe-droit, ni un motif de discrimination<\/strong>. Deux objectifs sont donc \u00e0 concilier\u00a0:<\/p>\n<p style=\"text-align: justify;\">&#8211; Permettre \u00e0 l\u2019organisation d\u2019articuler prise en compte des singularit\u00e9s individuelles et continuit\u00e9 de l\u2019activit\u00e9\u00a0;<\/p>\n<p style=\"text-align: justify;\">&#8211; Permettre aux individus d\u2019articuler leurs attentes en mati\u00e8re de religiosit\u00e9 et celles en mati\u00e8re de professionnalit\u00e9.<\/p>\n<p style=\"text-align: justify;\"><strong>Cela doit se faire en anticipation<\/strong>, et donc \u00e9galement dans les organisations pas encore confront\u00e9es massivement \u00e0 ce ph\u00e9nom\u00e8ne, car <strong>le management est un syst\u00e8me quasi-juridictionnel<\/strong> (Laufer, 2018). En effet, les managers de proximit\u00e9 produisent de la jurisprudence manag\u00e9riale locale, lorsqu\u2019ils d\u00e9cident sans conna\u00eetre le droit ou la posture.
